2013 lawsuit against EDC to produce records

Brevard County Clerk of the Circuit Court Scott Ellis and the Economic Development Commission of Florida’s Space Coast, Inc. (EDC) reached a settlement agreement on Thursday in the 2013 lawsuit filed by the Clerk against the EDC to produce records in its possession relative to BlueWare, Inc. and affiliated companies.

BREVARD COUNTY, FLORIDA – Brevard County Clerk of the Circuit Court Scott Ellis and the Economic Development Commission of Florida’s Space Coast, Inc. (EDC) reached a settlement agreement on Thursday in the 2013 lawsuit filed by the Clerk against the EDC to produce records in its possession relative to BlueWare, Inc. and affiliated companies.

The document sets forth the agreement between the parties.

Highlights include:

• The EDC admits that when the Clerk made his public records requests, the EDC was subject to the Public Records Act as it related to portions of their contract with Brevard County.
• The EDC will have 45 days in which to produce any and all records it still has in its possession relative to BlueWare to the Clerk, or, if the EDC contends an exemption from the Public Records Act exists, to the circuit court for in camera inspection by the Court.
• Upon full compliance by the EDC with the settlement agreement, the Clerk will voluntarily dismiss the lawsuit against the EDC.

The Clerk was represented by Alec Russell, Esq. of GrayRobinson, P.A., and Orange County Commissioner Ted B. Edwards, Esq. was the mediator chosen by the parties to mediate the case.
