BREVARD COUNTY • MIMS, FLORIDA (WESH) – A Brevard County man who has spent three years in jail awaiting trial for manslaughter was freed under Florida’s “stand your ground” law.

Warren Buchanan is accused of punching German Heredia, a Mims grandfather who died after the altercation.

Heredia, was on an evening walk with his 6-and 9-year-old granddaughters in their Mims neighborhood in January 2016. Prosecutors said he and Buchanan got into an argument after Buchanan told the older man not to touch his truck.

Buchanan said Heredia came after him. While prosecutors said all Heredia did was touch Buchanan’s truck and quarrel, the defense claimed he lunged toward Buchanan.
