According to Palm Bay public information officer Yvonne Martinez, Joseph Kyle Lamay, 24 of Palm Bay was taken into custody late Thursday by officers with the Garden Grove, California Police Department.

Lamay was arrested during a traffic stop for a violation of probation warrant regarding drug charges from Brevard  County.

It’s believed Lamay left Palm Bay on Sunday to see relatives in California. Detectives with the Palm Bay Police Department’s Special Victims Unit (SVU) want to re-interview Lamay regarding the circumstances surrounding the death of Lorenzo Hernandez, last Friday.

According to Martinez, Lamay was babysitting the boy for his girlfriend when, just after 1 a.m. Friday he called 9-1-1 to report the boy had fallen, was unresponsive and not breathing.

Detectives continue to investigate the death and are working with the State Attorney’s Office and the Medical Examiner’s Office to determine a definitive cause and manner of death.

“As with any death investigation we are being very methodical in order to make sure we reach the truth,” said SVU Sgt. Chris Livasy. “There is a process that must take place. There are questions we still need answers to in order to make sure justice is done in this case.”
