BREVARD COUNTY • COCOA BEACH, FLORIDA – Cocoa Beach police officers shot and killed Tim Berger, 59, of Cocoa Beach, in his home late Friday evening, February 16, at about 10:20 p.m.

According to Cocoa Beach Police Chief Scott Rosenfeld, the shooting followed a 9-1-1 call from Berger’s wife, stating her husband was intoxicated, suicidal and had just fired a gun inside their home.

“Several officers approached the second-floor unit of the Royal Colonial Condos, 2001 S. Banana River Blvd., #215,” said Rosenfeld in a statement.

“As officers arrived at the unit, they attempted to make contact with Berger and were immediately met with an imminent, violent threat that resulted in a deadly force response by Officers James Scheiner and Taylor Payne, who both discharged their firearms.”

Berger subsequently died on-scene and both officers were uninjured in the encounter.

“Florida Department of Law Enforcement was contacted to handle the investigation, with the assistance of the Brevard County Sheriff’s Office Crime Scene Unit,” said Rosenfeld.

“Officer Scheiner has been with the Cocoa Beach Police Department since June 2015, Officer Payne since May 2016. Both officers have been placed on paid administrative leave until further notice, as is standard protocol.”

According to Rosenfeld, no further information will be made available by police until the independent investigation is complete.
