City of Melbourne Adopts Temporary Outdoor Seating Policy to Help Local Restaurants

BREVARD COUNTY, FLORIDA – Governor Ron DeSantis recently announced the Safe, Smart, Step-By-Step Plan to Reopen Florida. Phase 1 of the plan will begin on Monday, May 4, and will allow the re-opening of restaurants and retail establishments at 25 percent capacity.
Restaurants may also offer outdoor seating with 6-feet of space between tables.
To help Melbourne’s restaurants take full advantage of this plan, the City of Melbourne has adopted a temporary policy to allow restaurants to expand a portion of their seating outdoors for on-site food consumption.
This temporary allowance includes the ability to place outdoor seating within parking or landscape areas and within the City’s right-of-way, subject to City approval.
This would include the ability to locate seating in accordance with the Zoning Code while maintaining adequate distance for ADA compliance; access to businesses; and any social distance requirements in effect.
In addition, the City will waive the $30 application review fee, the $100 sidewalk-use base fee, and the $25 per-seat fee. This allowance will only be good through the Declared State of Emergency.
The City of Melboune requires an application permit for this temporary outdoor seating along with a scaled drawing that shows all dimensions and spacing related to the seating areas, accessibility and clearance requirements, and the number of tables and chairs that will be used outside
