Brevard Sheriff Ivey Makes Sure Man Accused of Threats Against Students, Law Enforcement Stays Behind Bars

Marvin Guth, 48, of Port St. John, was arrested Thursday morning after he was seen near Space Coast Jr./Sr. High, causing a lockdown. 

BREVARD COUNTY, FLORIDA – I want to give everyone an update on the results of the bond hearing this afternoon for subject Marvin Guth, who was arrested by our agency yesterday for Trespass On School Grounds and a Warrant For Failure To Appear.

The Failure To Appear Warrant was issued after Guth failed to show for court on a previous case where he threatened to kill students at one of our local Elementary Schools and also kill law enforcement officers.

I personally attended the Initial Appearance for Guth today as I wanted to make certain that the presiding Judge had a strong understanding of how significant a threat I feel this man is to our children, our teachers, our citizens, and our law enforcement officers.

Prior to attending the Initial Appearance, I spoke directly with our State Attorney, Will Shiner, who shared the same concerns for the safety of our community.


According to court records, Guth was trespassed from Enterprise Elementary School in March. In February, he threatened to “burn the school to the ground.” 


Based upon the affidavit for arrest and the previous threats by Guth to harm children and law enforcement officers, the Honorable Judge Baker immediately revoked his bond and changed it to a “No Bond” status.

In addition, Judge Baker also gave Guth a bond of $15,000 on the new trespass charge, which is just a formality, as he is being held on “No Bond” on the other charges, which keeps him from being able to bond out.

I want to personally thank our Deputies for their quick actions yesterday to get Guth into custody, our State Attorney’s Office for their representation on the case, and, of course, Judge Baker for recognizing that this man is an absolute threat to society and the only place he belongs is behind bars!

I also want to thank our citizens for their response to this issue and for always partnering with us to keep our community safe. Guth is now locked behind bars, where he belongs and where he can’t hurt anyone.
