Brevard Commission to Hear Heated Merritt Island Apartment Rezoning Case
The Board of County Commissioners is now scheduled to consider the rezoning request during its 5 p.m. zoning meeting on Thursday, May 7, at the Brevard County Government Center, located at 2725 Judge Fran Jamieson Way in Viera.
The proposed development would be built on an 11.24-acre site north of Hampton Manor and Pioneer Road, west of Raintree by the Lake.
The property is currently zoned Agricultural Residential, and the developer is seeking to rezone it to Medium-Density Multiple-Family Residential to allow construction of the apartment community.
County commissioners postponed the public hearing on April 2 after the applicant, Merritt Bidco SPV LLC, requested additional time to explore the acquisition of adjacent property and consider possible revisions to the project, including changes to the number of units and other elements of the plan.
The proposal has sparked strong opposition from residents across Merritt Island, with more than 2,800 people signing an online petition urging county leaders to reject the rezoning request.
Residents argue that the development would place additional strain on already congested roadways and increase flood risks in the surrounding area.
According to the petition, opponents believe the apartment complex would worsen what they describe as an “already dire traffic situation,” increasing the risk of accidents for both motorists and pedestrians.
The petition also raises concerns about stormwater management and drainage.
“Moreover, the potential for increased flooding cannot be ignored, as the natural drainage systems that protect our land are already strained,” the petition states.
“This development would further stress these resources, leading to possible flooding disasters for our homes and businesses.”
The property is owned by Merritt Bidco SPV LLC, a New York-based special purpose vehicle. According to the Brevard County Property Appraiser’s Office, the land had a market value of approximately $1.7 million in 2025.
The proposed project has undergone several rounds of review over the past several months, and the commission voted to delay the matter during its April 2 zoning meeting.
