Brevard County Jury Finds Xaviar Turner Guilty of the First Degree Felony Murder of Dimitric Bailey

The State had waived the death penalty and Turner now faces a mandatory life sentence

A Brevard County Jury found Xaviar Turner, 23, above left, guilty of First Degree Felony Murder and Robbery with a Firearm for his role in the robbery and murder of Dimitric Bailey on July 29, 2018, in Cocoa. According to police, Turner and two other defendants, Kenneth Levatt, 25, above right, and Markice Harvey, 26, then executed a planned robbery and shot Bailey before fleeing the scene.

BREVARD COUNTY, FLORIDA – A Brevard County Jury found Xaviar Turner, 23, guilty of First Degree Felony Murder and Robbery with a Firearm for his role in the robbery and murder of Dimitric Bailey on July 29, 2018, in Cocoa.

Cocoa police reported that a surveillance camera captured Dimitric Bailey park his car in front of a home in the 1700 Block of Vagabond Street.

According to police, Turner and two other defendants, Kenneth Levatt, 25, and Markice Harvey, 26, then executed a planned robbery and shot Bailey before fleeing the scene.

Cocoa police officers later found Bailey deceased in his car.

All three men were subsequently arrested and held on murder and robbery charges.

Turner was ordered held in the Brevard County Jail for sentencing scheduled for October 23. The State had waived the death penalty and Turner now faces a mandatory life sentence.

Levatt and Harvey are still in custody awaiting trial.
