BREVARD COUNTY • MIMS, FLORIDA – A Mims man was killed Saturday night when his ATV struck a tree and overturned.

Sgt. Kim Montes of the Florida Highway Patrol said Raymond A. DeLeon of Mims, 47, was driving a 2008 Yamaha ATV while carrying a passenger about 9:47 p.m. Saturday near Leather Fern Lane and Gopher Slough Road in Mims.

Montes said DeLeon was traveling eastbound on Leather Fern Lane when he approached some standing water and mud in the center of the dirt roadway.

According to Montes, DeLeon attempted to maneuver left to go around the water and mud and traveled partially onto the north shoulder of the road.

The left side of the ATV struck a tree and a mailbox.

Montes said because of DeLeon’s failure to maintain control of the vehicle and the subsequent collisions, the ATV overturned, ejecting both driver and the passenger, Michael A. Creel of Mims, 46.

Neither DeLeon or Creel were wearing helmets at the time and toxicology reports will determine if alcohol played a factor in the crash.

The ATV eventually came to rest on its side and DeLeon was pronounced dead at the scene.

Creel was transported to Parrish Medical Center in Titusville for treatment of minor injuries.

Montes said the crash remains under investigation.
