Scott McElman of Cocoa Beach Busted On Numerous Drug-Related Charges Following Months-Long Operation

McElman was in possession of 55 grams of Meth, 20 grams of Fentanyl, 3 grams of Heroin

BREVARD COUNTY • COCOA BEACH, FLORIDA – Scott McElman, 37, of Cocoa Beach, was taken into custody Tuesday, April 12, on numerous drug-related charges following a months-long joint operation involving Cocoa Beach, Cocoa and Melbourne Police Departments, FDLE, FBI and DEA.

The following is the arrest narrative by the Cocoa Beach Police case agent:

The defendant Scott McElman was in possession of approximately 55 grams of Methamphetamine, 20 grams of Fentanyl, 3 grams of Heroin, and 3 grams of a controlled substance Amphetamine and Dextroamphetamine.

“The defendant was also in possession of multiple items of drug paraphernalia to include small baggies for sale and distribution, multiple digital scales for sale and distribution, needles loaded with a brown liquid (suspected Heroin) as well as spoons (with residue), lighters, and other bags with residue. The above items were located and seized during a search warrant at the defendant’s residence.

On April 12, at approximately 5 p.m., I along with other members of the Cocoa Beach Police Department as well as members of the FBI and DEA executed a search warrant at 285 Corona Avenue, Cocoa Beach, Brevard County, Florida, 32931. The search warrant was in reference to a separate case report (22-0922) in which defendant Scott McElman sold methamphetamine, heroin, and alprazolam to an undercover agent. An arrest warrant was drafted and served earlier this day.

On Tuesday, April 12, I along with agents from the FBI and DEA were in place to execute an arrest warrant on the defendant / Scott McElman. At approximately 2:30 p.m., McElman left his residence on his electric bicycle and proceeded East on South 3rd Street. McElman then turned right and traveled south on South Brevard Avenue towards my location.

I identified myself and ordered McElman to stop. McElman fled on his electric bicycle southbound. Cocoa Beach Police Department Officer Matthew Teat, ID81 was in the area and observed McElman during the same time. Officer Teat activated his lights and sirens in a marked police department vehicle and McElman continued to flee. McElman rode his bicycle onto the beach at the beach end of South 2nd Street and proceeded northbound.

McElman was observed by multiple officers as he continued northbound. Cocoa Beach Police Officers along with Brevard County Sheriff’s Deputies were in the area of Shepard Park as McElman approached. The officers detained McElman without incident when he arrived to their location. As the officers placed McElman in hand restraints, a witness advised that McElman had thrown a small plastic baggie of a white powdery substance just before being taken into custody.

The substance was located and seized by officers on scene. The white powdery substance is approximately 1 gram of suspected fentanyl. The property was seized along with McElman’s bicycle. McElman was transported to the Cocoa Beach Police Department for the warrant and additional charges in reference to Officer Teat’s case report number 22-1000.

Immediately after McElman left the residence, Cocoa Beach Police Officers traveled to the residence to ensure no one else entered or exited the residence pending a search warrant. Based on the totality of the investigation, I drafted a search warrant for McElman’s residence. The warrant was reviewed by the state attorney’s office then signed by the Honorable Judge Ingram.”

“At approximately 5 p.m., I along with other members of CBPD, FBI, and DEA executed the search warrant. After clearing the residence the search was focused on McElman’s bedroom which was located on the second floor on the west side of the residence. The room was photographed prior to beginning the search. The room was confirmed to be McElman’s with bank cards and clothing that McElman had previously worn to previous drug sales.

The room was further confirmed to be McElman’s when his mother arrived and said that the room was his (McElman’s) and that no one else went upstairs. During the search, over thirty (30) used syringes were found uncapped throughout the bedroom. Several loaded (with suspected heroin) syringes were located and seized. Paraphernalia such as multiple packages of small baggies and multiple digital scales with a white powdery residue, both commonly used for the sale and distribution of narcotics were found and seized.

“A black safe was located in the bedroom. Inside the safe was several different substances individually packaged for sale,” Cocoa Beach Police’s agent concluded.

Among the substances were the following:

■ Bag 1-28g of a white crystal substance (Methamphetamine) total weight not including the bag
■ Bag 2-23g of a white crystal substance (Methamphetamine) total weight not including the bag
■ Bag 3-2g of a white crystal substance (Methamphetamine) total weight with bag
■ Bag 4-1g of a white crystal substance (Methamphetamine) – total weight with bag
■ Bag 5-1g of a white crystal substance (Methamphetamine) total weight with bag
■ Bag 6-14g of a white powdery substance (Fentanyl) total weight with the bag
■ Bag 7-5g of a white powdery substance (Fentanyl) total weight with the bag
■ Bag 8-1g of a white powdery substance (Fentanyl) total weight with the bag
■ Bag 9-1g of an unknown white rock substance total weight with the bag
■ Bag 10-2g of a purple powdery substance (Heroin) total weight with the bag
■ Bag 11-1g of a purple powdery substance (Heroin) total weight with the bag
■ Bag 12-one unknown blue pill
■ Bag 13-seven (7) orange pills – Amphetamine and Dextroamphetamine 20mg

All identified substances were seized and field-tested with a presumptive result. The substances were individually packaged and submitted into evidence at the Cocoa Beach Police Department.
