UPDATE: Barricaded Suspect in Viera Taken into Custody By Brevard Deputies Following Domestic Incident

The Brevard County Sheriff’s Office arrested 39-year-old Patrick Kelly of Viera and charged him with Aggravated Assault/Domestic Violence with a Deadly Weapon and Discharging a Firearm on Residential Property, according to Brevard County Sheriff’s Office spokesman Tod Goodyear.

BREVARD COUNTY FLORIDA – The Brevard County Sheriff’s Office arrested 39-year-old Patrick Kelly of Viera and charged him with Aggravated Assault/Domestic Violence with a Deadly Weapon and Discharging a Firearm on Residential Property, according to Brevard County Sheriff’s Office spokesman Tod Goodyear.

Kelly, a member of the Cocoa Police Department, who was off duty at the time, was taken into custody after barricading himself in his residence following a domestic incident.

“Deputies responded to a residence on Framura Lane in Viera at approximately 10:30 p.m. on December 27, 2022, after the victim contacted the Sheriff’s Office advising Kelly had threatened her with a firearm and was experiencing an emotional crisis,” said Goodyear.

“The victim, who was able to flee from the residence, stated Kelly threatened to harm her, as well as himself and any responding members of law enforcement. She further advised Kelly was armed and had barricaded himself inside the residence.”

According to Goodyear, the Brevard County Sheriff’s Office SWAT Team responded and ultimately negotiated Kelly to exit the residence and surrender without further incident. During the incident, Kelly discharged multiple rounds within the residence.

No injuries were sustained by Kelly or members of the Sheriff’s Office during the incident. He was transported to the Brevard County Jail with a No Bond status.

Cocoa Police Chief Evander Collier: We are saddened by the events of the last 24 hours involving two of our officers. At approximately 10:30 p.m. Wednesday, Brevard County Sheriff’s Office SWAT team and crisis negotiators responded to Officer Pat Kelly’s home in Viera, where he was involved in a domestic disturbance with another Cocoa Police Officer.

Cocoa Police Chief Evander Collier issued the following statement:

We are saddened by the events of the last 24 hours involving two of our officers. At approximately 10:30 p.m. Wednesday, Brevard County Sheriff’s Office SWAT team and crisis negotiators responded to Officer Pat Kelly’s home in Viera, where he was involved in a domestic disturbance with another Cocoa Police Officer.

“Officer Kelly was armed and was actively shooting inside of the home. After several hours, Officer Kelly surrendered without further incident. There were no injuries.

While there are those in the community that will take this opportunity to attribute the actions of Officer Kelly to current departmental leadership, Officer Kelly was previously arrested back in 2017 for felony domestic violence battery. After those charges were dropped, Officer Kelly was allowed to remain with the Department.

He has been with the department since December 10, 2007, and is now suspended without pay, pending termination.

Cocoa Police Officers are held to the highest levels of professional and moral conduct and Officer Kelly’s actions do not represent the men and women of this agency who take pride in their job every day to protect and serve our community.

We are grateful for the quick and professional response from the Brevard County Sheriff’s Office in facilitating a peaceful resolution of the standoff and we will move forward by providing support to the Cocoa police officer and victim who shared the home with Officer Kelly.
