Melbourne Man Indicted by Grand Jury for First Degree Murder of David Herles

Noe allegedly killed David Herles, 66, from Melbourne

BREVARD COUNTY, FLORIDA – The Brevard County Grand Jury issued murder indictment for a local man in the murder of 66-year-old David Herle in Melbourne.
Theodore Noe, 43, was indicted for First-Degree Felony Murder and Arson of a Dwelling.
On November 15, 2023, at 09:43 a.m., Melbourne Police and Fire Fighters responded to a 911 report of a home on fire on Guava Avenue.
While attempting to extinguish the blaze they discovered Herles lying on the ground and severely burned.
Transported to the Orlando Regional Medical Center, Herles died from his injuries at approximately 11:30 pm that same day.
Over the next six months, investigators learned that Noe and Herles were both local homeless transients who at different times had been living on the porch of the home where the fire occurred.
On the day of the murder, Noe had been staying on the porch but returned home to find Herles asleep there. Angered, Noe set the fire that subsequently killed Herles.
The Grand Jury heard testimony from law enforcement investigators, a fire marshal, and civilian witnesses before returning with the indictment.
