BREVARD COUNTY • VIERA, FLORIDA — Opening statements began on Wednesday in the murder trial of Erica Dotson, accused of failing to protect her 3-year-old son, Jameson Nance, from weeks of abuse that ultimately led to his death in 2021.
Prosecutors painted a grim picture of Dotson’s alleged inaction.
Assistant State Attorney Samantha Barrett told the jury, “Many people failed Jameson Nance. But no one failed him so profoundly as the one person whose job it was to keep him safe… his own mother, this defendant Erica Dotson.”
Authorities say Dotson’s boyfriend at the time, Joshua Manns, physically abused Jameson, and prosecutors plan to present text messages between Dotson and Manns that allegedly discuss the child’s injuries and ways to conceal them.
In one message, Dotson reportedly referred to her son as a “jerk.”
Prosecutors also contend that Dotson fabricated explanations for the injuries, including claiming to daycare staff that a duck had attacked the boy. An autopsy concluded Jameson’s death was due to “battered child syndrome.”
If convicted of first-degree murder, Dotson faces the possibility of the death penalty.
The defense argued that Dotson was unaware of the full extent of the abuse.
Attorneys said she was a “busy-working mom and student” who trusted the explanations Manns gave for her son’s injuries. They also emphasized that Dotson was the one who called 911 when Jameson was found dead.
An autopsy revealed that Jameson had signs of battered child syndrome, including a broken rib, brain swelling, and head injuries. Investigators determined the abuse had been ongoing for much longer than just the day Jameson died.
Testimony on the first day of the trial included statements from Jameson’s biological father, James Nance, who said that after Dotson began dating Joshua Manns, she restricted his access to his son. A pediatrician who had treated Jameson also testified.
Dotson’s former boyfriend, Manns, faces separate murder charges, and his trial date has not yet been set.
Prosecutors plan to introduce more than 13,000 text messages as evidence in Dotson’s trial, which is expected to last approximately four weeks.
